구속된 만주노총 한상균 위원장과 민주노총 노동자들 석방운동이 세계로 확산되고 있다. 국제인권단체인 엠네스티의 조사 발표에 이어 <진보한국을 위한 유럽연대>가 대한민국 사법부가 이들을 조속히 석방할 것을 촉구하는 청원서를 배포하고 세계인들의 서명을 받고 있다. 다음의 청원서는 한국어, 영어, 서반아어, 독일어로 배포되었다.

대한민국 사법부는 헌법이 규정하는 노동자의 권리를 보장하라
2016년 6월 13일, 대한민국 검찰(주임검사: 이성식)은 지난해 11월 정부의 노동법개악에 저항하는 집회를 주도한 혐의로 구속된 민주노총 한상균 위원장에게 징역 8년을 구형했다.
2014년 12월 민주노총 위원장으로 선출된 한상균은 노동법개악에 저항하는 총파업 투쟁을 2015년 4월과 7월 이끌어 냈다. 그리고 11월 14일, 13만명이 참여한 민중총궐기 집회를 여러 단체들과 함께 주최한 뒤, 조계사에서로 25일간 은신했다. 경찰이 그를 체포하기 위해 조계사에 공권력을 투입하려 하자 그는 2015년 12월 10일 경찰에 자진 출석했다.
6개월이 지난 뒤인 6월 13일 검찰은 징역 8년을 구형하면서 "위원장으로 당선된 당시부터 치밀하게 범행을 계획했고 직책을 이용해 범행을 선동했으며 반성하지 않는 점 등을 고려해 이같이 구형 한다"고 밝혔다.
그러나 이날 불법을 저지른 것은 오히려 경찰이었다. 경찰은 집회에 참여한 시민들을 경찰차로 고립시키고 최루액을 난사하였으며, 사람을 향해 직접 물대포를 쏘아서 백남기 농민은 지금까지 혼수상태에 빠져있으나, 검찰은 조사조차 하지 않았다. 대신 11월 집회에 참여한 노동자 중 한상균 위원장을 비롯한 20명의 노동자를 구속했으며, 그 중 10명이 현재까지 감옥에 있다.
집권당 여당과 정부는 1) 징계절차를 필요로 하지 않는 쉬운 해고, 2) 비정규직 고용 확대, 3)차별임금체계를 도입하여 임금을 더 낮추고, 노동자간 경쟁을 부추기며, 4) 노조의 기능 자체를 무력화 시키는 것을 골자로 하는 노동개악을 추진 중이다. 한마디로 현재보다 훨씬 더 열악한 비인간적 노동환경을 만들고 기업의 이익을 극대화하려는 것이 법안의 주된 내용이다. 지난 11월 14일 민중총궐기는 이러한 노동법 개악으로부터 2천만 전체 노동자들의 권리를 지키기 위해 반드시 필요한 것이었다.
대한민국 헌법 33조 1항은 노동자가 근로조건의 향상을 위하여 자주적인 단결권·단체교섭권 및 단체행동권을 가진다고 명시하고 있다. 노조연합이 노동자의 생존을 위협하는 노동악법에 저항하는 것은 헌법이 규정한 권리임에도 불구하고, 검찰이 이러한 구형을 내린다는 것은 그들이 더 이상 법의 집행인이 아니라, 노동자를 짓밟는 권력의 하수인임을 자임하는 것이다. 재판부(부장판사: 심담)는 7월 4일 1심 판결을 앞두고 있다.
한상균은 무죄다. 대한민국이 여전히 민주공화국임을 자임한다면, 대한민국 사법부는 한상균과 구속된 민주노총 노동자들 모두 석방하라. 대한민국 국회는 노동법 개악안을 폐기하고, 노동자의 권리를 확대하고, 노동자들이 행복한 조건에서 일할 수 있도록 노동법을 개혁하라.

To South Korean Judge, SHIM Dam: Respect the workers' constitutional rights! Immediately release HAN Sang Gyun, President of KCTU!
On June 13, 2016, Korean prosecutor Lee Sung Sik demanded that Han Sang Gyun, the president of KCTU (Korean Confederation of Trade Unions), be sentenced to eight years behind bars for organizing a protest last November against the Korean government’s proposed package of labor law revisions.
Mr. Han was elected as the leader of KCTU in December of 2014 and successfully organized nationwide protests both in April and July of 2015. Then, after an arrest warrant was issued for him for having co-organized a mass rally on Nov, 14 with a number of NGOs present and reportedly 130,000 other participating citizens, he had to find a temporary asylum at the Buddhist Chogye temple in Seoul for twenty-five days. Upon hearing the police's attempt to enter the temple, he turned himself in on December 10th, 2015.
The prosecution stated on June 13th that "We request a sentence of eight years considering that he had been conspiring to [to commit crimes] since his election, incited the crime using his position of power, and does not show any sign of remorse."
On the contrary, though, in reality it was the police who committed the crime on November 14th. The police isolated the participating citizens by ushering them away by a bus barricade, and tear gas. BAEK Nam Gi, a farmer, has been in coma since then, which was caused by a water cannon attack. Yet, prosecutors didn't bother to investigate the case. Instead, twenty workers, including Mr. HAN, were arrested from the rally and ten of them are still in prison.
The Korean government and the ruling party are pushing the enactment of a new labor law. Their main objectives are: 1. Easy dismissal of employment without need of proper procedure 2. Increase of precarious jobs (low-wage short-term jobs) 3. Introduction of a wage system that will lower the income of workers and stimulate the extreme competition among them. 4. Disablement of the basic functions of labor unions. In short, it will worsen the preexisting and inhumane working conditions and will maximize the interests of the big corporations.
The people's mass rally on November 14th was a necessary struggle designed to protect every right of the twenty million working men and women in Korea.
Korean constitution article 33.1 clearly states that workers have a right to independent association, and collective bargaining and action to improve working conditions. Obviously, workers and their trade unions have a right to resist against any laws that could seriously undermine their survival & interests and it is guaranteed by the constitution.
The prosecution's request, ignoring the constitution, simply admits the fact that they serve the powerful as they trample on the basic human rights of these workers, rather than executing their lawful duties. The sentence is expected to be announced on July 4th by judge SHIM Dam. HAN Sang Gyun is innocent.
Judge SHIM Dam should release HAN Sang Gyun and all of the imprisoned KCTU workers if he still believes that the Republic of Korea is a true democracy. We demand the Korean parliament to abolish the new labor law, extend the rights of workers, and reform the labor law to guarantee pleasant working conditions for our workers.
